Publication Requirement in New York for LLC/LLPs

New York Publication Requirement

New York requires newly formed entity or foreign registrations of LLCs, LLPs, and PLLCs to complete a publication requirement shortly after formation. Specifically, LLCs, LLPs, and PLLCs must publish a notice of their formation in two newspapers in the county of their choosing. These options are presented to users when submitting the formation or foreign registration filing.

The county clerk designates the two approved newspapers (typically one daily and one weekly), and the notice must run for six consecutive weeks. After publication is complete, the newspapers provide affidavits of publication, which are then filed with the state along with a Certificate of Publication.

In general, the full process takes approximately 8–12 weeks after you New York registration is complete, depending on county processing times and newspaper schedules.

Even if the formation or foreign registration is complete (shown in Filing History), the publication requirement may still be processing. The publication will be charged separately and at this point, you will be able to navigate back to Filing History and now download the evidence associated with publication. It will be grouped together with for formation or foreign registration filing in New York.
